Overview of the IQOS CLUB Program

 1.1 IQOS CLUB is a badge-based program for our loyal IQOS users. Through IQOS CLUB, you can collect badges by performing certain actions, and by combining different badges, you gain access to various Benefits, including unique events and experiences, chances to win prizes, and special offers.

1.2 1.2 We use certain defined terms in these general terms which are bolded. A list of these defined terms is provided in section 12.

 

Application of General Terms

2.1 These general terms (General Terms) apply and govern your participation in the IQOS CLUB program (IQOS CLUB). The General Terms should be read carefully as they affect your legal rights and govern the nature of your relationship with BAR-KOD D.O.O, Dr Rajka Đurišića br. 3, 81000 Podgorica (Organizer).[TO1] [IJ2] .

2.2 During your membership, you agree to be bound by these General Terms. If you do not agree with or cannot comply with the General Terms, you can cancel your membership at any time by contacting IQOS customer service (email address: contact.me@iqos.com; toll-free call: 080 800 005). Membership in IQOS CLUB and the General Terms apply in the country of your registered residence according to the IQOS database of existing users.

2.3 We also reserve the right to amend the General Terms and technical terms, services, and Benefits of the IQOS CLUB program at any time based on a notice published on the website. If you do not agree with such amendments, you can terminate your membership in the IQOS CLUB program.

2.4 Amendments to the General Terms by you are not allowed unless the Organizer issues explicit consent in writing.

 

Eligibility

3.1 You will use the IQOS CLUB program under the conditions of these General Terms. The Organizer reserves the right to reject your application for IQOS CLUB for any reason. We may also terminate your right to use the IQOS CLUB program for any reason, including program suspension, concept changes, user groups eligible to participate in IQOS CLUB, and violation of any of these General Terms.

3.2 You will be eligible for membership in the IQOS CLUB program only if: (i) you are an adult IQOS device user over 18 years old and registered in our IQOS database; and (ii) your residence is in Montenegro.. 

3.3 Membership in the IQOS CLUB program is open only to individuals. Companies, partnerships, unincorporated associations, and other legal entities are not eligible for membership.

3.4 An IQOS CLUB member cannot have multiple memberships. You can maintain only one account in the IQOS CLUB program.

 

Membership Conditions

4.1 To become a member of IQOS CLUB, you must have at least one registered eligible device, as described in section 4.2 (Device) in our database. If you have more than one registered Device, you will still have only one membership in the IQOS CLUB program. If we amend the General Terms and then use the services and Benefits of the IQOS CLUB program or register another Device, you agree to be bound by the amended General Terms. You can register the Device: (i) on your account on the iqos.com website, (ii) by calling the customer center at 080 800 005, or (iii) in IQOS zones participating in the program.

4.2 You can have the following Devices for your membership in the IQOS CLUB program: 4.2.1 IQOS 2.4, IQOS 2.4+, IQOS 3, IQOS 3 MULTI, IQOS DUO, IQOS DUO ORIGINALS, IQOS ILUMA PRIME, IQOS ILUMA, IQOS ILUMA ONE 4.2.2 If applicable, any future IQOS device that will entitle you to membership in the IQOS CLUB program will be listed in the updated version of these General Terms.

4.3 Registration can be done at any time provided you are an adult and registered user of one of the listed Device models.

4.4 Membership in the IQOS CLUB program and actions you take in connection with your membership and Benefits are personal and cannot be transferred to third parties.

4.5 The IQOS CLUB program is available only in certain countries. Your use of the IQOS CLUB program is tied to the country in which you reside. If you change your country of residence, your membership in that country automatically expires, and you must notify us and reapply for the IQOS CLUB program in the new country of residence if the IQOS CLUB program is available in that country, and under the conditions determined by the local organizer.

Benefits

5.1 As a result of your membership in the IQOS CLUB program and based on the badges you have earned, you will be entitled to the Benefits listed on the IQOS CLUB program Benefits page, which you can see here: [JM12]  [https://clubme.iqos.com/prizes]

5.2 You can earn Benefits by collecting badges. The process for earning badges is described in section 7. The selection of Benefits you can earn depends on their availability. Some Benefits are automatically earned by winning a specific badge, while other Benefits require a badge to apply for the reservation of the Benefit. For certain Benefits, you may need to possess a combination of specific badges.

5.3 Only you can request the reservation of Benefits based on the badges you have earned. Benefits can only be used by you unless a specific Benefit explicitly states that other persons can use it.

5.4 Benefits must be used during your Status period, alternatively and, if applicable, within the period specified by the Benefit. Benefits that are not used within the given period expire. If you do not use a Benefit that is scheduled for a specific date or time, it will result in the cancellation or expiration of the Benefit.

5.5 Certain Benefits (such as devices at the most favorable prices) are exclusively and only for CLUB members. The Organizer may change these Benefits at any time, and they can only be used once during the status period.

5.6 Some Benefits may be provided by our business partners (Business Partners). Business Partner Benefits may be subject to the General Terms of the Business Partner. The Organizer will make reasonable efforts to ensure the availability of such Benefits but will not be responsible for any loss caused by the Business Partner's failure to provide such Benefit, except in cases where such failure was caused by the Organizer. In such cases, the Organizer's liability will be limited to the monetary value of the Benefit.

5.7 The Organizer reserves the right to: (i) terminate relationships with Business Partners and access to such Benefits for any reason at any time; and (ii) amend Benefits for any reason at any time. The Organizer will notify you of any such changes, for example, through the latest information on the IQOS CLUB program website or via Viber or email.

5.8 From time to time, the Organizer may offer value vouchers to IQOS CLUB program members as a form of Benefit. Such vouchers may be offered for services from IQOS CLUB partners. General terms published with each voucher offer will apply to them and, in case of conflict, will take precedence over these general terms.

5.9 If, after receiving any Benefit from us, you decide to share content about our products on social media, please do so responsibly, considering that IQOS is not a risk-free product and is intended only for adult smokers who would otherwise continue smoking, so your content should not be available to minors or non-smokers. Additionally, for transparency, please indicate appropriately that you received the Benefit from us.

 

Badges

6.1 As a member of the IQOS CLUB program, you have the opportunity to earn Badges (Badges) for activities with the Organizer and our business partners in various ways.

6.2 A Badge is a digital certificate awarded to IQOS CLUB program members for specific activities or sets of activities during a defined validity period.

6.3 Possession of Badges unlocks the possibility of earning Benefits specifically defined for each Badge. Some Badges automatically unlock the defined Benefits, while others unlock the possibility of applying for defined Benefits, with the winners of the Benefits being predefined (fastest application, etc.).

6.4 Badges are earned based on activities. Some ways include: purchasing a new IQOS ILUMA device, recommending IQOS ILUMA or lil SOLID devices to adult smoker friends (using your referral CODE), registering on the IQOS CLUB program website, ... and other ways described in the Badges section on the IQOS Club website. The Organizer may, at its discretion, change the rules and ways of earning Badges at any time, with prior notification, including through amendments to these Terms on the website, changes to the relevant section on the IQOS Club website, or by sending notifications via Viber, email, or other suitable means. 6.5 The validity period of Badges may vary: i) Occasional Badges: Linked to a specific campaign or activities, their activation and expiration dates are linked to the start and end of the campaign or activities they relate to. The validity period of such Badges is predefined and clearly indicated for each badge, and they can only be earned once during the related campaign or activities. ii) Permanent Badges: The validity period of these badges is within one calendar year (from January 1 to December 31 of the current year) and can only be earned once during the calendar year. iii) Status Badges: have an unlimited validity period unless indicated otherwise within the badge description.

 6.6 Badges can only be earned by you and cannot be transferred to another member or any third party.

6.7 The Organizer records Badges on your membership account. Badges cannot be cashed out.

6.8 In case of any dispute over the right to Badges, the Organizer may require you to provide proof of the activity for which you are claiming Badges. If a Badge does not appear automatically after completing the qualifying activity, you must submit a request for the Badge to the Organizer within six (6) months of completing the activity.

6.9 Badges cannot be combined with any other loyalty program.

Term and Termination

7.1 Your membership in the IQOS CLUB program begins on the day of your first registration in IQOS CLUB and acceptance of these General Terms.

7.2 You can terminate your membership in the IQOS CLUB program at any time with immediate effect by notifying the Organizer via the designated email address contact.me@iqos.com or by calling the toll-free number 080 800 005.

7.3 By participating in the IQOS CLUB loyalty program, you agree to the following:

- You will not abuse the IQOS CLUB program, including activities related to this program and Benefits;

- You will not obtain Badges or Benefits by amplifying the activities that qualify you for them through social media or in any other way directed at an indefinite number of people, or by engaging third parties to participate in activities that qualify you for Badges or Benefits, nor by providing false information, misleading, or in any other fraudulent manner;

- You will treat our staff and the staff of our Business Partners with kindness and respect;

- You will keep your membership account secure and safe;

-You will comply with applicable law; and

- You will comply with these General Terms & Conditions..

7.4 The Organizer has the right to investigate the participation of any IQOS CLUB member to detect any intentional or unintentional irregularities in the use or abuse of the referral CODE, with the aim of obtaining personal gain. The investigation is carried out whenever a referral CODE is used more than 5 times, or when there are other reasons to suspect irregularities. A member can share their referral CODE in any way they wish, as long as the communication can be characterized as personal communication. Advertising or mass promotion of the referral CODE is strictly prohibited and will result in immediate exclusion from IQOS CLUB, as well as the forfeiture of earned Badges and Benefits. The Organizer reserves the right to terminate the validity of the CODE based on the results of the investigation, and in the case of established misuse, to cancel any previously achieved result using such a referral CODE. Any member whose referral CODE is deactivated automatically loses the right to re-enter IQOS CLUB.

7.5 The Organizer, in cooperation with companies from the Philip Morris International (PMI) group, will receive, store, and otherwise process your personal data in connection with the administration of the IQOS CLUB program and your participation in it. To learn how we will use your personal data collected in connection with your IQOS CLUB account, please read the PMI Privacy Notice at the following link:https://me.iqos.com/en/terms/14-privacy-notice. For the full service of the IQOS CLUB program, you will receive notifications from IQOS CLUB regarding the program.

7.6 If you violate the General Terms, the Organizer may terminate your membership in the IQOS CLUB program at any time with immediate effect. The Organizer may also terminate your membership for any reason 30 days after giving notice.

7.7 Upon termination or expiration of your membership, you no longer have the right to any of the services and Benefits from the IQOS CLUB program, except for those from the IQOS CARE PLUS program, which will remain in effect until the expiration of the warranty on your Device. All unused vouchers and other Benefits are automatically canceled within four weeks, except in cases of established irregularities, when they may cease immediately upon termination of membership in IQOS CLUB.

 

Warranty/Statements/Limitation of Liability

8.1 Since membership in the IQOS CLUB program is free, it is provided without any warranties.

8.2 The Organizer makes no representations about any income, use, or other tax obligations you may have as a result of your membership in the IQOS CLUB program. We advise you to contact your accountant or tax advisor for additional information, and you are solely responsible for any tax obligations arising from your membership in the IQOS CLUB program, the use of vouchers, or the receipt of Benefits.

8.3 To the maximum extent permitted by applicable law, the Organizer is not liable for any direct losses, loss of profits, sales, revenue, or savings, business downturn, reputational harm, and/or similar losses, loss or alteration of data or information, purely economic losses, or for any special, indirect, or consequential losses, costs, damages, or compensation arising or otherwise resulting from your membership in the IQOS CLUB program or your use of services or Benefits within the IQOS CLUB program. The Organizer is not liable for any loss mentioned in section 8.3, even if you have notified the company of potential similar losses.

8.4 Nothing in section 8 excludes liability that cannot be excluded by applicable law.

 

Ownership and Risk

9.1 Ownership of Badges remains with the Organizer at all times and never transfers to you. You have the right to use the Benefits in accordance with these General Terms.

9.2 All risk related to the Benefits transfers to you as soon as you use the Benefit.

 

Non-Transferability

10.1 Except as expressly determined by the Organizer for a specific Benefit in writing, Badges and Benefits (including vouchers) cannot be exchanged for money, nor can they be refunded or exchanged. Badges and Benefits (including vouchers) cannot be bought, sold, exchanged, or otherwise transferred to any third party, including any other member, unless specifically approved. The Organizer may cancel any Badges, vouchers, and other Benefits traded in this way, contrary to these General Terms.

10.2 Any attempt to sell or transfer Badges, vouchers, or Benefits contrary to these General Terms constitutes a violation of the rules and will automatically result in the termination of your membership.

 

Other Provisions

11.2 The Organizer reserves the right to suspend or terminate your right or the right of any person using, or in the case of suspension, suspected of using the IQOS CLUB program, in a manner inconsistent with these General Terms or applicable law. In addition to suspending or terminating the right to use the IQOS CLUB program, the Organizer has the right to take appropriate administrative and/or legal actions, which it deems necessary at its discretion.

11.3 The Organizer's failure to enforce these General Terms does not constitute a waiver of these general terms or any of their provisions.

11.4 The collection of Badges and Benefits is determined by the Organizer at its discretion.

11.5 Upon the death of any member, all Badges, vouchers, and Benefits collected by that member are automatically canceled.

11.6 All questions or disputes regarding the right to use the IQOS CLUB program, the availability of Benefits, or compliance with these General Terms will be resolved by the Organizer at its discretion. The Organizer's decision is binding.

11.7 The Organizer is not responsible for any inaccurate or incorrect data you provided during participation in the IQOS CLUB program, nor for any lost or incorrect notification you received or sent in connection with the IQOS CLUB program.

11.8 You are responsible for maintaining up-to-date contact information on your IQOS CLUB account.

11.9 Notifications from the Organizer in accordance with this document may be provided in writing, including via Viber or e-mail.

11.10 The General Terms are subject to the laws of the place of the Organizer's registered office. All legal disputes will be subject to the exclusive jurisdiction of the relevant authorities in the city where the Organizer's registered office is located.

11.11 Any provision of these General Terms that any competent authority or court declares invalid or unenforceable, to the extent of such invalidity or unenforceability, will be considered severed and does not affect the remaining provisions which remain unchanged.

11.12 If there is any conflict in meaning between the version of these General Terms in English and the version in Montenegrin, the Montenegrin version prevails.

 

Definitions

12.1 For the purposes of these General Terms:

Benefits

means the benefits from the IQOS CLUB program listed from time to time in section 5.1

Device

means an eligible IQOS device for the models listed in section 4.2

IQOS CLUB

has the meaning described in section 2.1

Organizer

has the meaning described in section 2.1

Badges

have the meaning described in section 6.1

Business Partners

have the meaning described in section 5.6

General Terms

have the meaning described in section 2.1
